Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NameSniper website located at namesniper.pro, its application programming interfaces, its MCP server, and all associated services (collectively, the "Service"), operated by NameSniper ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years of age (or at least 13 with the consent of a parent or guardian where local law permits) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

NameSniper is a brand-name intelligence and handle-monitoring platform that provides:

  • Domain name availability checking across 20+ extensions
  • Social media username availability checking across major platforms, with verified results on selected platforms for Day Pass, Pro, and Business plans
  • Handle monitoring: watching usernames for availability changes and sending alerts by email, in-app notification, or webhook
  • AI-powered brand name generation and alternative suggestions
  • Brand scoring and analysis (Ownability Score: domain, social-handle, and trademark availability)
  • On-demand trademark similarity screening and risk indication (Day Pass, Pro, and Business plans)
  • Linguistic and cultural screening of names across selected languages
  • Informational market data for tradable usernames, such as Telegram usernames listed on Fragment, sourced from public blockchain records
  • Programmatic access through the NameSniper API and MCP server on eligible plans

The Service provides informational results based on publicly available data, third-party platforms, and third-party APIs. Results are not guaranteed to be fully accurate or up-to-date and must not be relied upon as legal, financial, or professional advice. Trademark screening is an automated similarity check, not a clearance search or legal opinion. Market data is provided for information only and is not investment advice.

3. Account Registration and Security

  • You may register using Google sign-in or an email address and password, or through other authentication methods we may offer from time to time.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must notify us immediately at info@namesniper.pro if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Early Access and Waitlist

Parts of the Service may be offered on an invitation or waitlist basis. Joining the waitlist does not create an account or guarantee access. During early access, features, limits, and pricing may change, and features may be added, modified, or withdrawn without notice. You may ask to be removed from the waitlist at any time by contacting us; we will delete your waitlist entry.

5. Subscription Plans and Billing

5.1 Plans

NameSniper offers the following tiers:

  • Guest and Free: A limited number of daily checks and, for registered Free accounts, a small number of handle watches at no cost.
  • Sniper ($4.99/month, or $39/year): Handle monitoring with more watch slots and faster check frequency, plus expanded daily checks.
  • Pro ($9.99/month, or $79/year): Unlimited checks (subject to fair use), verified results on additional platforms, AI name generation, trademark screening, and API access.
  • Business ($24.99/month, or $199/year): Everything in Pro plus higher API limits, more API keys and webhook destinations, more watch slots with faster check frequency, and priority support.
  • Day Pass ($2.99 one-time): 24 hours of unlimited checks (subject to fair use) and premium features. Not a subscription and does not renew.

5.2 Fair Use and Quotas

"Unlimited" refers to normal, interactive use by a single person or organization. All plans, including unlimited ones, are subject to reasonable rate limits and anti-abuse controls, and to the daily, monthly, watch-slot, and API quotas shown on the pricing page and in your dashboard. Guest and Free daily quotas are enforced per account or, for guests, per network address. We may throttle or suspend usage that materially exceeds these limits or that appears automated outside of authorized API access.

5.3 Billing

  • All payments are processed through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring monthly or yearly basis, depending on the billing period you select. Day Passes are charged once and do not renew.
  • Prices are listed in US Dollars. Prices are shown inclusive of any applicable taxes unless stated otherwise at checkout.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing cycle.
  • When a paid plan ends or is downgraded, watches, API keys, and webhooks above the limits of your new plan may be paused or disabled.

5.4 Price Changes

We may modify pricing with at least 30 days' advance notice via email. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5.5 Refunds

All fees are non-refundable except where required by applicable law. By starting a Day Pass or subscription you request immediate access to digital services and acknowledge that the statutory 14-day right of withdrawal ends once the service has begun. If you believe you have been charged in error, contact us within 14 days of the charge at info@namesniper.pro.

6. Handle Monitoring and Alerts

  • Monitoring checks watched usernames and domains at plan-based intervals and notifies you when we detect a change. Detection depends on third-party platforms that change their behavior, rate-limit us, or block automated access without notice. We do not guarantee that every change will be detected, or detected within any particular time.
  • An alert is information, not a reservation. We do not register, claim, or hold any name on your behalf, and we do not guarantee that a name reported as available can be obtained by you.
  • Alerts are delivered on a best-effort basis by email, in-app notification, or to webhook endpoints you configure. Delivery can be delayed or fail because of email providers, your endpoint, or network conditions. You are responsible for keeping your contact details and endpoints correct.
  • You may only monitor names for lawful purposes. Monitoring must not be used to harass, impersonate, or infringe the rights of others, or to circumvent a platform's rules.
  • Watches are deleted when you remove them or close your account, and watches may be paused when a plan lapses. Alerts already sent for a watch are retained for up to 90 days after the watch is removed, then purged.

7. API, MCP Server, and Developer Access

  • Programmatic access is provided through the NameSniper API and MCP server on eligible plans and, for limited unauthenticated use, under rate limits we set. Access is subject to these Terms and to the plan quotas and rate limits published in our documentation.
  • API keys are issued to you personally or to your organization. You are responsible for keeping keys secret and for all use made with them. Do not embed keys in client-side code or share them. We may rotate, suspend, or revoke keys to protect the Service.
  • You may build applications and AI agents on the API and MCP server, including for commercial use, provided you do not resell raw availability data as a competing checking service, do not misrepresent results as guaranteed, and identify NameSniper as the data source where results are shown to end users.
  • Webhook endpoints you register must be under your control. You are responsible for securing them and for verifying request signatures.
  • The API is provided without a service-level agreement. We may change or deprecate endpoints, and will make reasonable efforts to announce breaking changes in advance.

8. Acceptable Use Policy

You agree not to:

  • Use automated scripts, bots, or scrapers to access or extract data from the Service other than through the API or MCP server within your plan limits.
  • Resell, redistribute, or commercially exploit data obtained from the Service without our prior written consent, except as permitted in Section 7.
  • Attempt to circumvent usage limits, rate limiting, plan gates, or access controls, including by creating multiple accounts.
  • Use the Service to infringe upon the intellectual property or rights of others, including domain squatting, cybersquatting, or registering handles in bad faith to impersonate a person or brand.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Upload or transmit viruses, malware, or other harmful code.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund.

9. Intellectual Property

9.1 Our Property

The Service, including its design, features, code, branding, documentation, and all related intellectual property, is owned by NameSniper and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

9.2 Your Content

You retain ownership of any content you provide to the Service (such as brand names, business descriptions, or watched handles). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

9.3 AI-Generated Content

Brand names and suggestions generated by our AI features are provided for informational purposes. We do not claim ownership of AI-generated names, and we do not reserve them for you: the same or similar names may be suggested to other users. We make no warranty that such names are available for registration, free from trademark conflicts, or unique. You are solely responsible for conducting your own due diligence before registering or using any name.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • Availability check results are 100% accurate or current. Domain and social media availability can change at any time, and some platforms limit what can be verified without logging in.
  • Monitoring will detect every change, or that alerts will arrive in time for you to act on them.
  • Trademark screening constitutes legal advice, is complete, or is a substitute for consultation with a qualified attorney.
  • AI-generated names or linguistic screening results are unique, available, culturally appropriate in every market, or free from intellectual property conflicts.
  • Market data for tradable usernames is complete, current, or an indication of value.
  • The Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAMESNIPER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, OR THE LOSS OF AN OPPORTUNITY TO REGISTER A DOMAIN OR CLAIM A USERNAME, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless NameSniper and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service, the API, or the MCP server
  • Your violation of these Terms
  • Your violation of any third-party rights or platform rules
  • Any domain name, brand name, username, or trademark you register or use based on information obtained from the Service

13. Termination

  • By you: You may close your account at any time through your account settings or by contacting us. Cancellation of a paid subscription takes effect at the end of the current billing period.
  • By us: We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include violation of these Terms, fraudulent activity, or extended inactivity.
  • Effect of termination: Upon termination, your right to use the Service ceases immediately, active watches stop, and API keys are revoked. We delete your account data within 30 days of termination, subject to legal retention obligations.

14. Governing Law

These Terms are governed by the laws of the country in which NameSniper's operator is resident, without regard to conflict of law rules. If you are a consumer, you also keep the protection of any mandatory consumer laws of the country in which you live, and nothing in these Terms limits those rights.

15. Dispute Resolution

If you have a dispute with us, contact us first at info@namesniper.pro and we will try to resolve it informally within 30 days. If we cannot, either party may bring the dispute before the competent courts of the operator's country of residence or, if you are a consumer, the courts of the country in which you live. EU consumers may also use the European Commission's online dispute resolution platform.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on this page and updating the "Last updated" date. For significant changes, we may also send an email notification. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

17. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and NameSniper regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights at any time without notice.
  • Third-party platforms: NameSniper is not affiliated with, endorsed by, or sponsored by any of the domain registries, social platforms, or marketplaces whose public data the Service checks. Their names and marks belong to their owners.
