Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NameSniper website located at namesniper.pro and all associated services (collectively, the "Service"), operated by NameSniper ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

NameSniper is a brand intelligence platform that provides:

  • Domain name availability checking across 20+ extensions
  • Social media username availability verification across major platforms
  • AI-powered brand name generation and suggestions
  • Brand scoring and analysis (memorability, SEO, professionalism)
  • USPTO trademark conflict detection and risk assessment
  • Smart alternative name generation with brand scoring

The Service provides informational results based on publicly available data and third-party APIs. Results are not guaranteed to be fully accurate or up-to-date and should not be relied upon as legal, financial, or professional advice.

3. Account Registration and Security

  • You may register using Google OAuth, GitHub OAuth, or other supported authentication methods.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must notify us immediately at support@namesniper.pro if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Subscription Plans and Billing

4.1 Plans

NameSniper offers the following subscription tiers:

  • Free: Limited checks with basic features at no cost.
  • Pro ($12/month): Expanded check limits, AI name generation, brand scoring, and priority checking.
  • Business ($39/month): Unlimited checks, trademark analysis, bulk operations, API access, and dedicated support.

4.2 Billing

  • All payments are processed through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring monthly basis.
  • Prices are listed in US Dollars and do not include applicable taxes, which will be added at checkout where required.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing cycle.

4.3 Price Changes

We may modify pricing with at least 30 days' advance notice via email. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.4 Refunds

All fees are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us within 14 days of the charge at support@namesniper.pro.

5. Acceptable Use Policy

You agree not to:

  • Use automated scripts, bots, or scrapers to access or extract data from the Service (including bulk querying our APIs outside of authorized API access).
  • Resell, redistribute, or commercially exploit data obtained from the Service without our prior written consent.
  • Attempt to circumvent usage limits, rate limiting, or access controls.
  • Use the Service to infringe upon the intellectual property or rights of others, including domain squatting or cybersquatting.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Upload or transmit viruses, malware, or other harmful code.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund.

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, code, branding, documentation, and all related intellectual property, is owned by NameSniper and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

6.2 Your Content

You retain ownership of any content you provide to the Service (such as brand names or business descriptions). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

6.3 AI-Generated Content

Brand names and suggestions generated by our AI feature are provided for informational purposes. We do not claim ownership of AI-generated names, but we make no warranty that such names are available for registration, free from trademark conflicts, or unique. You are solely responsible for conducting your own due diligence before registering or using any name.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • Availability check results are 100% accurate or current. Domain and social media availability can change at any time.
  • Trademark analysis constitutes legal advice or is a substitute for consultation with a qualified attorney.
  • AI-generated names are unique, available, or free from intellectual property conflicts.
  • The Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAMESNIPER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless NameSniper and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any domain name, brand name, or trademark you register or use based on information obtained from the Service

10. Termination

  • By you: You may close your account at any time by contacting us or through your account settings. Cancellation of a paid subscription takes effect at the end of the current billing period.
  • By us: We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include violation of these Terms, fraudulent activity, or extended inactivity.
  • Effect of termination: Upon termination, your right to use the Service ceases immediately. We may delete your account data within 30 days of termination, subject to legal retention obligations.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@namesniper.pro. We will attempt to resolve the dispute within 30 days.

12.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Wilmington, Delaware, by a single arbitrator.

12.3 Class Action Waiver

You agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on this page and updating the "Last updated" date. For significant changes, we may also send an email notification. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and NameSniper regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights at any time without notice.
